Funding of Legal-Bay prosecutions focused on wrongful convictions and imprisonment cases

TRENTON, New Jersey, February 25, 2021 / PRNewswire / – Legal-Bay LLC, the lawsuit settlement finance company, has announced its commitment to providing loans for the financing of lawsuits for victims of wrongful imprisonment and malpractice. Our nation’s prison population currently stands at over two million, and Legal-Bay research indicates that up to 3% are currently serving time for crimes they did not commit. Unfortunately, most of these unjustly incarcerated people will never have the chance to prove their innocence and will spend irreplaceable and lost years behind bars, even in prison for life.
The problem is compounded by the fact that there are simply too many questionable cases and too few resources to investigate them all. Human rights groups such as The Innocence project have stepped up their efforts to try to rectify the situation by focusing on DNA evidence. In the almost 30 years since their inception, the organization reports 375 exonerations, including more than 20 innocent prisoners who were on death row.
Many exonerated victims have returned to court – as plaintiffs this time – to seek justice for their unjust incarceration. In addition to wrongful imprisonment, many complainants allege police brutality, false arrests, excessive force, torture and forced confessions. Many of these cases were high profile cases that caused lasting physical and psychological damage to the victims. Failed prison systems and the cities that housed them have already been forced to pay countless millions in damages and many more cases have yet to be heard.
Legal-Bay is committed to helping those wrongly incarcerated get back on their feet and has approved cases north of $ 1 million in immediate settlement loan funding. Seed funding provides coverage if a plaintiff loses the case or if the case drags on for years.
Chris Janish, CEO commented, “We are one of the few companies that truly understand this niche finance market. It can be difficult to understand which cases have merit and which do not. company with approval amounts exceeding $ 1 million in many cases. Most importantly, our capital which is provided is by far at the lowest rates in the industry, and with cap provisions that ensure our clients will pay a fixed amount after 30 months. the amount will never increase, no matter how long the case lags in court or on appeal. I don’t think any other company in the legal finance industry can stand for the same thing. “

Here are some recent and high-profile litigation across the country that Legal-Bay has funded in small or large part:
NEW YORK:
Just last week, a Idaho man pleaded guilty to sexual assault and murder of 18 year old Angie Dodge in her Idaho Falls apartment in June 1996. Brian Dripps Sr. was not arrested for the crime until May 2019 after his DNA sample linked him to the murder scene.
For Christophe Tapp, the man who has been serving a sentence for a fatal stabbing since 1998, the arrest came twenty-three years too late. Based on a forced confession, Tapp was sentenced to 30 years in life imprisonment even though his DNA sample did not match. Nineteen years later, the Idaho Innocence Project took over the case and Tapp was finally released in 2017. He was exonerated two years later.
Mr Tapp has since filed a complaint against the city of Idaho Falls for his wrongful conviction. His trial date is currently pending.
ILLINOIS:
Anthony S. Ross, Tyjuan T. Anderson, and Lumont D. Johnson will each receive $ 3.7 MM of their lawsuit for wrongful imprisonment. The three men claim they were framed by police for the murder of an 8-year-old boy in 2002. They served thirteen years of their 50-year sentence before the convictions were overturned in one. Illinois court in 2015. Each of the innocent men filed separate wrongful conviction lawsuits against the city of Rockford and Doug palmer, the former detective who coerced individuals into making false statements.
During the retrial, Palmer said he fabricated evidence and coerced testimony, forcing the city to come up with a settlement. Reports show that the plaintiffs could have received a much higher payment. Similar cases nationwide have been settled for amounts greater than $ 1 million for each year spent in prison.
CALIFORNIA:
The state of California leads the nation in exonerating wrongly convicted individuals. According to a 2018 report from the National Registry of Exemptions, more than 2,000 former detainees have been vindicated since 1989. This is only a small triumph given that this particular group spent a combined total of 20,000 years in prison for crimes they did not commit, an average of almost nine years per person.
A new bill (SB 938) has recently been passed which makes it easier for those wrongly convicted to claim damages. For the nearly 700 people who have already chosen to sue, the state of California has since rewarded $ 300 million in payments.

Legal-Bay currently funds loans for settlements in the following cases: wrongful incarceration, wrongful imprisonment, wrongful conviction, prosecutor misconduct, police brutality, false arrest, excessive force and rape or assault in prison. Legal-Bay has been a leader in providing pre-settlement money for many of these cases as well as all personal injury and commercial litigation cases. While Legal-Bay offers loans on settlement amounts based on a plaintiff’s prepayment at the end of their trial, the amount of financial compensation awarded by the courts will depend on the type of claim made or before a jury.
Legal-Bay’s lawsuit loan programs are designed to provide immediate liquidity prior to the plaintiff’s anticipated monetary compensation. Non-recourse cash financing, sometimes referred to as a court loan or a settlement loan, is risk-free because the money does not need to be repaid if the recipient loses their case. So, although this article sometimes mentions terms like settlement loans or loan settlement, the correct terminology is actually pre-settlement litigation funding, as lawsuit loans are not really a loan, but rather an advance of funds.
